Penalty Abatement

Didn’t file or pay your return on time? It happens. Did you know you may qualify for a penalty abatement? An abatement is a forgiveness of the penalties imposed by the IRS. That’s right, you could possible get out of the entire penalty. The absolute worst thing you can do is ignore the letter. Not only will the penalties continue to increase, the IRS could eventually place a lien on your own property. Every tax paying American is protected by the Tax Payer Bill of Rights. 

Do these three situations apply to you?


  • You didn’t previously have to file a return or you have no penalties for the 3 tax years prior to the tax year in which you received a penalty.
  • You filed all currently required returns or filed an extension of time to file.
  • You have paid, or arranged to pay, any tax due.

Offer in Compromise

Have a large tax bill that you cannot afford? An offer in compromise allows you to settle your tax debt for less than the full amount you owe. It may be a legitimate option if you can't pay your full tax liability, or doing so creates a financial hardship.  The IRS will consider your unique set of facts and circumstances such as:

  • Ability to pay
  • Income
  • Expenses
  • Asset equity

The IRS will consider two major factors when deciding whether or not to accept your Offer:


Is this the most the IRS collect?
Can it collect in a reasonable amount of time?


In order to be approved for an Offer in Compromise, you must be eligible. Osprey will work with to determine eligibility and take the necessary steps to give you the best chances possible.

Innocent Spouse

Have a large tax bill, penalties, or interest that you feel as if you don’t deserve due to a current or former spouse? Osprey can work with you to file innocent spouse relief. By requesting innocent spouse relief, you can be relieved of responsibility for paying tax, interest, and penalties if your spouse (or former spouse) improperly reported items or omitted items on your tax return. Generally, the tax, interest, and penalties that qualify for relief can only be collected from your spouse (or former spouse).  


To meet the qualifications of innocent spouse relief you must show:

  • You filed a joint return which has an understatement of tax due to erroneous items, defined below, of your spouse (or former spouse).
  • You establish that at the time you signed the joint return you did not know, and had no reason to know, that there was an understatement of tax. 
  • Taking into account all the facts and circumstances, it would be unfair to hold you liable for the understatement of tax. 


You and your spouse (or former spouse) have not transferred property to one another as part of a fraudulent scheme. A fraudulent scheme includes a scheme to defraud the IRS or another third party, such as a creditor, ex-spouse, or business partner. 

Installment Agreements

Large tax bills can be crippling to an individual’s or business’ finances.  What if you can’t afford a large IRS Tax Bill? An Installment agreement may be the answer! Did you know that you’re guaranteed approval if you meet certain criteria? Osprey can determine if you meet that criteria and even assist you in getting there.


By approving your request, The IRS agrees to let you pay the tax you owe in monthly installments instead of immediately paying the amount in full. In return, you agree to make your monthly payments on time AND to file all your future tax returns on time.
